2. Information only — no legal advice
The content of the Website describes our services and provides general information about accessibility legislation, including the Estonian Accessibility of Products and Services Act (LPS), the European Accessibility Act (Directive (EU) 2019/882), EN 301 549 and WCAG 2.1. This information is provided for general guidance and does not constitute legal advice. Whether and how the legislation applies to your business must be assessed with your own legal counsel.
3. Intellectual property
All content on the Website — texts, graphics, layout, logos and code — is owned by or licensed to Estonicist and protected by copyright and other intellectual property laws. You may view and print pages for your own business use. Any other reproduction, distribution or modification requires our prior written consent. Third-party names and trademarks (e.g. Shopify, WooCommerce, Magento) belong to their respective owners and are used for identification only.
4. Acceptable use
You agree not to misuse the Website, including by attempting unauthorised access, interfering with its operation, scraping content in bulk, or submitting false, abusive or unlawful content through our forms.
5. Availability and changes
We aim to keep the Website available and accurate but do not guarantee uninterrupted availability or that content is free from errors. We may change, suspend or discontinue any part of the Website at any time.

7. Liability
To the extent permitted by law, Estonicist is not liable for any indirect or consequential loss arising from the use of, or inability to use, the Website or reliance on its content. Nothing in these terms limits liability that cannot be limited under Estonian law, including liability for intentional misconduct or gross negligence.
Part B — General terms for audit services
These general terms apply to the “Accessibility Act Check” and related services unless a separate written agreement provides otherwise. A binding engagement arises only when we confirm an order in writing (including by email).
8. Service description
The Accessibility Act Check is a fixed-scope accessibility audit of one online shop against WCAG 2.1 level AA as referenced by EN 301 549, delivered within five (5) working days of the agreed kick-off. The scope — pages, templates, flows, devices and test accounts — is agreed at kick-off and recorded in writing. Work outside the agreed scope is offered as an add-on at the published or quoted rate.
9. Client obligations
The client provides timely access to the shop, functioning test accounts, a technical contact, and any information reasonably required. Delays caused by missing access or information extend the delivery date accordingly.
10. Deliverables and intellectual property
Deliverables (report, issue log, accessibility statement draft, walkthrough) are provided for the client's internal use and for publication of the accessibility statement on the audited shop. Estonicist retains ownership of its methodology, templates and know-how. The client may not resell the report or present it as an independent certification.
11. Nature of the audit — no guarantee of compliance
The audit is an expert assessment at a point in time and based on the agreed scope and sample. It does not and cannot guarantee that the shop is or will remain compliant with the LPS, the European Accessibility Act or any other law, nor that no supervisory authority or third party will raise claims. The decision on legal obligations and on implementing recommendations rests with the client.
12. Fees and payment
Fees are fixed as published on the Website or quoted in writing, in euros and excluding VAT. Invoices are issued on delivery of the report and are payable within 14 days. Late payment accrues statutory interest under the Estonian Law of Obligations Act.
13. Re-check
One re-check of issues rated “critical” in the report is included if requested within 90 days of report delivery. The re-check covers the reported critical issues only and is delivered as an updated report and statement.
14. Confidentiality
Both parties keep confidential all non-public information received in the course of the engagement and use it only for the engagement. Estonicist may name the client as a reference only with the client's consent.
15. Cancellation
The client may cancel free of charge up to 5 working days before the agreed kick-off. Later cancellation incurs 50 % of the fee; cancellation after the kick-off call incurs the full fee, less any reasonably saved costs.
16. Liability
Estonicist's total liability under an engagement is limited to the fee paid for that engagement, except for damage caused intentionally or by gross negligence, or where liability cannot be limited by law. Estonicist is not liable for indirect loss, loss of profit, or fines or orders imposed by authorities.
17. Governing law and disputes
These terms are governed by the laws of the Republic of Estonia. Disputes are first addressed through good-faith negotiation; failing that, they are resolved by Harju County Court (Harju Maakohus), Tallinn, unless mandatory law provides otherwise.
18. Changes to these terms
We may update these terms from time to time. The version published on the Website at the time of your use or order applies.
